Shi\u2019ite Vs el-Rufai: Absence Of IGP Stalls Hearing

The judge handling the suit filed by the Islamic Movement in Nigeria (IMN) popularly known as Shi\u2019ites challenging its proscription by the Kaduna State Government and the harassment of its members by law enforcement officials which came up for hearing today was stalled following the absence of one of the respondents, the Inspector General of Police (IGP).<\/p>\n
The interlocutory application due for hearing on Thursday April 26, 2018 could not be heard because the IGP had been served hearing notice and was not represented in court.
\nPresiding Judge of Federal High Court 1, Justice Saleh Musa Shuaibu directed that the hearing notice be served on the IGP ahead of May 16, when the case is adjourned to.
\nSpeaking to newsmen outside the court, Counsel to IMN, Barrister Alex Ajodo said that they intended filing a counter affidavit.
\n\u201cThe matter for hearing today in between interlocutory applications which should have been heard first. It was for us to file further affidavit to counter the affidavit filed by the first to fifth respondents and the 6th and 8th respondents respectively,\u201d he said.
\nOn his impression about yet another adjournment on the matter, he said it was in order.
\n\u201cThe same interlocutory applications could not be heard today because the IGP has not been served.
\n\u201cThe adjournment came about and the court directed that the hearing motion be served on the IGP along with all the processes filed,\u201d he added.
\nIt would be recalled that the IMN filed the suit seeking to overturn its proscription by the Kaduna State Government led by Malam Nasir el-Rufai, joining seven others in the suit as respondents over harassment of members of the group.
\nThey are basing their argument on the fundamental right to worship and association as enshrined in the constitution of the Federal Republic of Nigeria.
